Booking Terms and Conditions

Pen y Cae is a really special place, and we want your stay there to be special too.

This means you need to understand what we expect of you, and what you can expect from us. We’re sorry that some of these are a bit legalistic, but they do represent the terms that you agree to when you use Pen y Cae, so they are important.

Please note that as the building is owned by Natural Resources Wales and leased by us, some of the T&Cs are embedded in the lease and so are totally non-negiotiable.

1 Booking

The Client who makes the booking and agrees to these Terms and Conditions will be responsible for their group and must be present during occupation, and should make sure that they are all aware of these Terms & Conditions.

The CIC have the right to decline any booking or refuse to hand over a key to any Client or person from their group who has not complied with these Terms & Conditions.

2  Payment

All booking must be paid for in full at time of booking, including the security deposit.

3  Cleaning

The Client is responsible for leaving the cottage in good order and in a clean condition.

This is really important. The only way the CIC can keep the costs of Pen y Cae so low is by not having cleaners.

Failure to do this, in the opinion of the CIC representative (which is final) will result in loss of the security deposit, and barring from making any further bookings.

4   Number of People using Pen y Cae

The Client may have up to 12 people staying at Pen y Cae.

5 Arrival/Departure

The cottage (unless otherwise agreed with the CIC) are available for occupation from 1 pm on the first day of the holiday and must be vacated by 11.00 am on the last day.

6  Cancellation or Changes by the Client

Once the stay is booked the Client has entered into this Contract with the CIC.

If the Client cancels, for any reason (including medical and weather related) no refund of the booking fee will be due.

If the Client has paid a security deposit then this will be refunded.

7  Holiday insurance

The Client and their group should take out a holiday insurance policy (which includes cancellation insurance covering sickness and unavoidable reasons for cancellation) prior to their stay. No liability whatsoever shall be accepted by the CIC for any losses sustained by the Client as a consequence of the Client not having holiday insurance.

8  Pets

No pets are allowed at Pen y Cae, except guide dogs, and then only by arrangement.

9  Damage, Loss, Theft

Clients agree to inform CIC of any damage or loss however caused, excluding reasonable wear and tear incurred during occupation. Clients should not remove any item from the property. The CIC may ask for reasonable replacement costs.

10 Nuisance

This Contract shall be treated discharged fully by the CIC or Agent in their sole and reasonable discretion, and they may repossess the property immediately, if any Client makes unreasonable demands before or during their stay including vexatious, meritless and unreasonable complaints about the condition or cleanliness of the property, its contents, defects or damage, or if a Client causes nuisance to other people. The Client will remain liable for the whole cost of rental and no refund or compensation for loss of holiday or enjoyment whatsoever shall be due.

11 Access

Clients must allow access to the property at any time by the CIC for maintenance and rectification of any defect.

12   Liability

The CIC will not be responsible, nor liable to Clients for any events outside the CIC’s reasonable control, such as the breakdown of domestic appliances, plumbing, wiring, temporary invasion of pests, building works at adjacent properties, damage resulting from exceptional weather conditions or other unforeseeable circumstances.

13   Wildlife

Pen y Cae is old and in a beautiful rural area and keeping all wildlife from being near or entering the cottage can be a hard or impossible job depending on the time of year. Please therefore expect to meet some wildlife, including some spiders, the odd mouse, bird, fly, bat, bee, wasp, ants or other creatures, which may make their way into a property unbeknownst to the CIC. Spiders in particular are not considered to be a pest and consume up to 2000 other insects per year. Usually it’s a temporary issue and any wildlife event is outside the CICs control. For this reason the CIC is not responsible for incursions of wildlife. In most cases  it is best simply to open a window or a door and let them out. If they become a serious pest then let the CIC know and they will try to help. CICs are entitled to decide that wildlife in perfectly reasonable in the context and also reserve the right to take no action if they do not consider the existence of the wild life to be a serious threat to health. Please bear this in mind before booking and if this is likely to be a problem for you, it would be best not to book.

14   Complaints Procedure

If a Client has any complaint about the property, it should be submitted to the CIC at the earliest opportunity and no later than 24 hours after its occurrence. If a Client chooses to abandon the property because of any alleged defects (whether minor or significant) before the CIC has been given a reasonable time and opportunity to rectify any defect, no refund or compensation whatsoever shall be paid to the Client or any person accompanying the Client.

Any minor defects and damage, including, but not limited to, non-functioning devices and installations, fittings and fixtures, missing items such as kitchen equipment,  or anything else considered to be minor defects which cannot be rectified by the housekeeper or CIC within a reasonable time or during the stay, shall not be deemed as defects which are fundamental to the Contract and will not be accepted as a complaint by the CIC or Agent, or subject to refund or compensation. Feedback forms are provided at the end of the stay, and are welcomed.

15   Liability

The CIC accepts no liability whatsoever for any personal injury material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, gas, electrical services or exceptional weather or damage caused by a Force Majeure event (see below). No responsibility is accepted for loss or damage of property, (including pets), vehicles or vehicle contents belonging to the Client or any member of the party during their occupancy.

16   Cancellation by CIC

The CIC reserves the right to refuse any booking and to cancel any bookings already made if the property is unavailable (for example, due to through fire, flood, etc) for any reason whatsoever, subject to a full refund of all monies paid (but no further liability). The CIC shall be under any other liability if such cancellation occurs.

17   No Smoking

There is no smoking within the Cottage.

18   Force Majeure

The CIC shall not accept responsibility and has no liability whatsoever for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, flooding of the property or its surrounding area and access roads, rain, landslides, mudslides, ice, snow, power cuts, fallen trees or branches, fallen fences; impeded, blocked, damaged or flooded access roads bridges or tracks, epidemics, acts of any government or public authority, or any other event outside our control or any lack of access to the property due to the forgoing. If the Client is unable to gain access to or use the property for any of these reasons no refund shall be made and no liability for loss of holiday or enjoyment accepted whatsoever.

19   Waiver

The failure of the CIC to enforce or exercise, at any time or for any period of time, any term of, or any right pursuant to this Contract does not constitute and shall not be construed as a waiver of such term or right.
